Revisions to the City of Lake Mary Arbor Regulations |

| On May 5, 2005, the approved the revision to the City’s Arbor Regulations, which are contained in Chapter 157 of the . The following is an overview of the most significant revisions to the City’s Arbor Regulations: |

| Arbor Permit Fees: If you live in a 1 or 2 family residence and plan to remove a tree, it is likely that you will need an Arbor Permit. At this time, there is a $30 application fee for 1 & 2 family residences. This fee is collected only if the permit is approved. No permit is required for trimming trees as long as the trimming does not result in the death of the tree. |

| All multiple family, office, retail and industrial developments must also secure an arbor permit to remove trees. This has not changed from the previous regulations. In addition, the City charges a fee for these permits which is based upon the size of the property, with $50 as the base. There is also a $30 application fee for a pruning permit. |

| Field Guidelines: The new Arbor Regulations established uniform field procedures for determining the distance between trees and structures. Measurements are taken from the closest vertical outside wall to the tree stump. Also, the revisions address how to determine the diameter of irregularly shaped trees. |

| Minimum Tree Coverage: Currently, Section 157.06 (D) states that each 1 & 2 family residence constructed in 1995 or later shall have a minimum number of trees and shrubs; however, there was not a minimum number of plantings for multiple family, office, retail and/or industrial developments. The revised Arbor Regulations added a new section, which established a minimum number of plantings for all development. |

| Violations: The revised Arbor Regulations changed the fine for the removal of historic trees as follows: initial fine = $500 for historic trees & additional fine of $100 per caliper inch. For all other protected trees the fines would be $250 & an additional fine of $50 per caliper inch. |

| Tree Replacement and Tree Banking: The revised Arbor Regulations established tree banking and changed the replacement schedule as follows: 1) less than 8” = 1 replacement tree or a contribution of $250 per tree; 2) 8” but less than 12” = 2 replacement trees or a contribution of $500 per tree; 3) 12” but less than 16” = 3 replacement trees or a contribution of $750 per tree; 4) 16” to 24” = 4 replacement trees or a contribution of $1,000 per tree. The removal of trees larger than 24” is prohibited, without approval of the Arbor Board. For trees in excess of 24”, 5 replacement trees are required. |
